Terms of Service

1. Acceptance of Terms

These Terms govern the use of Floovibe, a non-commercial project operated by the individual George Alin Gilea. By using the app, website and connected services, you accept these Terms, the Privacy Policy and the “Technologies & Storage” notice. If you do not accept them, do not use the service.

2. Service Description

floovibe is a social platform that allows users to create, discover and participate in local events and group activities. The Service includes, without limitation:

• Creating and managing events with thematic categories • Discovering and joining nearby events via geolocation • User interaction through event chats and direct messages (DMs) • Creating and viewing Stories: temporary multimedia content that expires automatically within 24 hours of publication • Sharing multimedia content in event galleries (with automatic 48-hour expiry) and in personal profile galleries • Route planning for outdoor events via Valhalla/OpenStreetMap • Expense splitting among participants (informational tracker only, with no actual payment processing) • Post-event review system • Event polls • Personal profile management, following and followers and privacy preferences

Events and content are created by users. Floovibe provides the platform’s technical tools and does not organise, co-organise, sponsor or guarantee users’ events. Mandatory obligations and liabilities under applicable law remain unaffected.

3. Registration and Account

A personal account is required to use Floovibe.

Registration requirements: (a) be at least 16 years old at registration; (b) provide the accurate, complete and current information requested by the form; (c) complete the required verification steps; and (d) choose secure credentials. You must not provide a false date of birth to bypass the age requirement.

Account security: you must take reasonable care of your credentials, not share them and notify us at security@floovibe.com if you suspect unauthorised access. These duties do not exclude Floovibe’s responsibilities for Service security under applicable law.

One account per person: duplicate personal accounts are not permitted. We may restrict, suspend or close accounts containing false information, duplicate accounts or accounts used in breach of these Terms, in accordance with applicable law.

4. Acceptable Use

You must use Floovibe lawfully and respect the rights of others. You must not publish or promote illegal, discriminatory, threatening, terrorist, fraudulent or unauthorised sexually explicit content; child sexual abuse material (CSAM); non-consensual intimate imagery; doxing; harassment; grooming; self-harm encouragement; illegal goods; spam; or intellectual-property infringement.

Impersonation, unauthorised scraping, unlawful access, phishing, unlawful data collection and attempts to bypass security controls or suspensions are also prohibited.

After a violation, Floovibe may remove content, restrict features, suspend or close an account and notify competent authorities where required by law or needed to prevent serious harm. Measures depend on severity, available evidence and applicable obligations.

5. User Content

You retain your rights in content you publish. You grant Floovibe a non-exclusive licence, limited in duration and scope to what is needed to store, process, display and distribute the content according to the feature and visibility settings you choose.

You are responsible for holding the necessary rights and permissions, including consent from identifiable people in media. Floovibe does not perform general proactive monitoring. Users can submit reports through the available tools or report@floovibe.com; authorised personnel may review a report and related content and take measures under these Terms.

6. Stories and Temporary Content

floovibe offers a "Stories" feature that allows users to share multimedia content visible for a limited period of 24 hours.

Characteristics: Stories are visible according to the choice made for each Story: public, followers. After 24 hours, Stories stop being visible in the feature. Removal from active systems and technical copies follows the periods and exceptions described in the Privacy Policy, including security, moderation and legal obligations.

Prohibited content in Stories: in addition to the general acceptable use rules (Section 4), the following are expressly prohibited in Stories: • Sexually explicit or pornographic content • Offensive, discriminatory content or content that harms the dignity of those depicted • Content featuring dangerous "challenges" that could be imitated causing physical harm • Content depicting people without their consent in intimate, compromising or private situations • Content depicting minors in inappropriate situations (see Section 8) • Any content prohibited by Section 4

Responsibility: the user is the sole and exclusive party responsible for content published in Stories. The temporary nature of the content in no way reduces the user's legal liability for any violations of these Terms or applicable law. floovibe reserves the right to remove Stories that violate these Terms before their natural expiry, and to retain a copy of removed Stories for moderation proceedings or to fulfil legal obligations.

7. Content Moderation and Reports

Users can report content, profiles, messages and events through the available tools or by writing to report@floovibe.com. Reports and related content may be reviewed by authorised personnel. Floovibe may remove content or restrict accounts after finding a breach of the Terms or the law. To request information or a review of a decision, you can contact appeals@floovibe.com. Floovibe does not claim to perform general proactive monitoring of all content.

8. Protection of Minors and Illegal Content

Creating, uploading, requesting or sharing child sexual abuse material (CSAM), grooming content or other content that endangers minors is prohibited. Users must report such content immediately through the reporting tools or report@floovibe.com. Floovibe may remove content, preserve necessary evidence, suspend involved accounts and notify competent authorities where required by law.

9. Cooperation with Competent Authorities

Floovibe responds to valid authority requests and may preserve or disclose data where required by law, needed for investigations or necessary to prevent serious harm. Requests are assessed and limited to relevant data. For legal communications, contact legal@floovibe.com.

10. Events

Events are created by users. A user who creates an event must provide accurate information, comply with applicable rules and clearly communicate known requirements, costs and risks. Floovibe provides the platform’s technical tools and does not organise, co-organise, sponsor or guarantee users’ events unless expressly stated.

For physical or outdoor activities, organisers and participants must independently assess conditions, equipment, personal ability, weather and instructions from competent authorities. Maps, routes, places and user-provided information may be incomplete or change. Floovibe is not a medical or emergency service.

Organisers can modify or cancel events using the available features. Notifications depend on the correct operation of the Service and the recipient’s settings. Nothing in this section excludes liability or rights that cannot be excluded under applicable law.

11. Shared Expenses and Payments

floovibe offers an expense splitting feature ("Expense Tracker") that allows event participants to record and split incurred costs.

Important: the expense splitting tool is exclusively an informational tracker. floovibe does NOT carry out, manage, process or intermediate any actual payment between users. We are not a payment institution and are not authorised to do so. Any financial transaction between participants takes place outside the platform and under the sole responsibility of the users involved.

floovibe is not responsible for: (a) the accuracy of amounts entered by users; (b) non-payment or failure to reimburse between participants; (c) disputes relating to expenses, shares or balances; (d) any financial losses resulting from use of the tool; (e) fraudulent behaviour by other users in the context of expense splitting.

Users may share payment information (e.g. PayPal email, bank account details) to facilitate reimbursements between themselves; this information is shared voluntarily and under their sole responsibility.

12. Communications

Floovibe provides event chats and direct messages. Communications must not be used for harassment, threats, spam, phishing, grooming, illegal content, CSAM or non-consensual intimate imagery.

Floovibe does not claim to perform systematic or general monitoring of private communications. Messages and related data may be accessed by authorised personnel when reported, when needed to resolve a security issue or where required by law. Users can manage who may contact them through the available settings and can block other accounts. A message removed from your view may remain visible to other participants according to the feature’s behaviour.

13. Gallery and Multimedia Content

floovibe offers gallery features for sharing photos and videos.

Event gallery: multimedia content uploaded to an event gallery is visible to all confirmed participants. Media uploaded to an event gallery stops being visible in the feature 48 hours after upload. Removal from active systems and technical copies follows the periods and exceptions described in the Privacy Policy.

Profile gallery: users can manage a personal gallery with albums and multimedia content, with granular privacy controls (public, followers only, private).

Technical limits: each uploaded file may not exceed 100 MB. Supported formats are images (JPEG, PNG, WebP, HEIC, HEIF) and videos (MP4, MOV, AVI, MKV, WebM). Users are subject to overall storage space limits.

Prohibited content in the gallery: • CSAM or any sexual content involving minors (see Section 8) • Intimate images of third parties published without consent (revenge porn) • Deepfakes of real people with sexual, denigrating or misleading content • Third-party copyright-protected content without authorisation • Content depicting minors in inappropriate situations (even not explicitly sexual), without parental or guardian consent • Content that violates the dignity of the people depicted • Any content prohibited by Section 4

User declarations: by uploading multimedia content, you declare that you: (a) hold all necessary rights, including image rights of any third parties depicted; (b) have obtained explicit consent from all adult subjects depicted; (c) have obtained parental or guardian consent for any minors depicted (e.g. in a family event). We reserve the right to remove any content in violation of these Terms.

Original copies and service limitations: Floovibe is not an archival, backup or permanent-storage service. Users must keep independent copies of their original content. To the extent permitted by law, we do not guarantee continuous availability, preservation, recoverability, quality or integrity of uploaded content. To provide the service, images and videos may be compressed, resized, transcoded, stripped of some metadata or otherwise technically adapted. Content may be removed because a feature expires, the user requests removal, moderation is required, technical or storage limits apply, security requires it, the service ends or the law requires it. Responsibilities that cannot be excluded and personal-data protection obligations remain unaffected.

14. Geolocation

Floovibe uses geolocation data to allow users to discover nearby events and manage event meeting points.

Location collection: geolocation data is processed only after you grant the device permission and when you use features that require it. You can withdraw the permission at any time in your device settings. Refusing or withdrawing permission does not prevent use of core features that do not require location.

Use: location data is used to: (a) show nearby events; (b) identify event destinations and meeting points; and (c) provide directions through third-party map services (OpenStreetMap/Valhalla). If you voluntarily enable background navigation, Floovibe may receive location updates while navigation started by you remains active; updates stop when you end navigation.

Floovibe does not use location for advertising or cross-app tracking and does not share it with other users unless you explicitly publish a location in an event.

Accuracy and safety: maps, places, opening hours, addresses, routes, distances, travel times and accessibility conditions may contain errors, be incomplete or change. They are not emergency services, professional advice or safety guarantees. Before travelling, users must verify real conditions, weather, restrictions, route difficulty and personal suitability, and must follow signs, competent authorities and emergency services.

15. Privacy

The collection, use and protection of your personal data are governed by our Privacy Policy, which forms an integral part of these Terms. By using the services, you acknowledge that you have received and reviewed the Privacy Policy. Acknowledgement is not blanket consent: each processing activity relies on the stated legal basis, and any optional consent remains separate and withdrawable. You have the right to access, modify, download and delete your personal data in accordance with the GDPR through the Settings > Privacy & GDPR section of the app.

16. Intellectual Property

The floovibe platform, including software, design, logos, trademarks, texts, graphics, icons and the overall look and feel of the service, is protected by copyright, trademark and other intellectual property laws. All rights are reserved to floovibe. Nothing in these Terms grants you the right to use the floovibe name, logo or trademarks without our prior written consent. If you believe that content on the platform infringes your intellectual property rights, please contact us at legal@floovibe.com with a detailed description of the alleged infringement.

17. Service Modifications and Interruptions

We reserve the right to modify, update, suspend or discontinue the Service, in whole or in part, at any time, with or without notice. We will endeavour to communicate substantial changes that may affect the user experience with reasonable advance notice. We will not be liable for any damages or inconvenience resulting from modifications, suspensions or interruptions to the Service.

18. Termination

Voluntary closure: you can request account closure in settings. The account is initially deactivated and can be recovered within 30 days. After that period, data is deleted in accordance with the Privacy Policy, subject to retention duties, security, dispute handling and requests from competent authorities.

Restriction, suspension or closure by Floovibe: we may act in the event of a breach of the Terms, abuse, a security risk, a legal obligation or a request from a competent authority. The action is assessed according to the context and applicable law. To request information or a review, you can contact appeals@floovibe.com; these Terms do not set an appeal deadline other than any deadline required by law.

Effects: when the account is closed, you lose access to the Service and the licence over your content ends, except as necessary to complete deletion, comply with legal obligations, protect security or manage proceedings and disputes.

19. Limitation of Liability

The Service may be affected by interruptions, maintenance, technical errors or unavailable third-party services. Floovibe is not an emergency service or a permanent backup or storage system; users must keep independent copies of their content.

Events and content are created by users. Floovibe does not organise users’ events, provide medical or emergency assistance, or process payments between participants. Users must verify maps, routes, places, times and real-world conditions.

Limitations in these Terms apply only to the extent permitted by law. They do not exclude or limit liability for wilful misconduct or gross negligence, death or personal injury attributable to Floovibe, data-protection obligations, mandatory consumer rights or any other liability that cannot lawfully be excluded.

20. Applicable Law and Jurisdiction

These Terms are governed by Italian law and applicable European Union law. This choice does not deprive consumers of mandatory protections under the law of the country where they reside. Territorial jurisdiction for disputes is determined by applicable mandatory rules, including the consumer’s local court where provided by law.

21. Changes to the Terms

We may update these Terms when the Service, applicable law or security requirements change. We will show the updated date and communicate material changes using appropriate means and any notice required by law. Where renewed acceptance or a separate consent is required, it will be requested expressly. If you do not accept an applicable change, you may stop using the Service and request account closure.
